국제인권단체, 문재인 대통령 당선자에게 백남기 농민 사건 수사 촉구 

어제(5월 10일), 태국 방콕 소재 국제인권단체인 인권과 개발을 위한 아시아 포럼 (포럼아시아, Asian Forum for Human Rights and Development, FORUM-ASIA)은 백남기 농민 사망 사건에 대해 철저하고 공정하며 독립적 수사를 할 것을 문재인 대통령 당선자에게 촉구하는 성명을 발표했다. 포럼아시아는 지난 2015년 12월, 민중총궐기 당시 상황을 포함한 한국 집회시위의 자유 실태에 대한 조사활동을 펼친 바 있다. 

 

포럼아시아는 성명에서 백남기 농민이 공권력의 무차별적이고 정당하지 못한 물대포 사용 때문에 부상을 입고 사망에 이르게 되었음에도 불구하고 지난 정권에서는 어떠한 사과도, 철저한 조사도 이뤄지지 않았음을 비판했다. 이에 새로 구성된 정부에서 백남기 농민 사망사건에 대한 조사를 우선시 해야한다고 촉구하며 과거 정부의 실패를 바로잡는 것은 한국이 인권을 보호하고 수호해 온 국가라는 이미지를 회복할 기회가 될 것이라고 밝혔다. 

 

포럼아시아는 2015년 당시 조사 보고서에 밝힌 바와 같이 무차별적이고 정당성이 없는 물대포 사용은 한국 및 국제 인권 기준을 위반한 것이라는 것을 다시 한 번 강조했다. 마지막으로 새로 선출된 대통령이 인권 이슈를 어떻게 다루는지에 따라 앞으로의 재임 기간 동안의 인권 기조를 구축할 수 있는 기회를 갖게 되는 것이라고 강조하며 백남기 농민 유가족들에게 공식적으로 사과하고, 철저하고 공정하며 독립적인 조사를 이행하며, 관련 책임자들을 처벌하는 것은 훌륭한 출발점이 될 것이라고 강조했다.

2017년 5월 10일 – 새로운 대한민국의 대통령이 선출되었다. 인권과 개발을 위한 아시아 포럼(포럼아시아)은 백남기씨의 죽음에 대해 철저하고 공정하며 독립적인 수사를 할 것을 새로 당선된 문재인 대통령에게 촉구한다. 이를 제대로 수행하지 못한다면 한국의 인권에 대한 신임은 떨어지게 될 것이다. 

 

2016년 9월 25일, 317일 동안 의식이 없었던 백남기씨가 숨졌다. 백남기씨는 박근혜 정부의 쌀 수입 정책에 항의하기 위해 2015년 11월 14일 개최된 민중총궐기에 참여했다가 당시 경찰이 쏜 물대포에 맞아 의식을 잃은 후 사망했다. 이 사건에 대해 전 유엔 평화로운 집회결사의 자유 특별보고관인 마이나 키아이씨를 포함해 도처에서 비판의 목소리를 높였고 독립적인 수사를 할 것을 지속적으로 촉구해왔다. 그럼에도 불구하고 이전 정부는 제대로 조사를 하기는 커녕 사과도 하지 않았다. 문재인 대통령 당선자가 이 실패를 바로잡는 것은 한국이 인권을 수호하고 보호해 온 국가라는 이미지를 회복하는 기회가 될 것이다. 

포럼아시아는 2015년 11월 14일 민중총궐기 당시와 2015년 12월 5일 열린 2차 민중총궐기 때 당국이 법을 위반했는지 여부를 조사하기 위해 국제인권조사단을 조직해 2015년 12월 4일~9일, 한국을 방문했다. 당시 국제인권조사단은 시민사회 단체, 기자, 변호사, 피해자, 국회의원, 그리고 국가인권위원회를 만났다. 조사단은 물대포의 사용, 버스 차별 설치, 집회 참가자 및 주최자에 대한 탄압의 형태로 국가 폭력에 의한 인권침해가 있었다고 볼 수 있는 근거가 있다고 결론지었다. 또한 조사단은 물대포가 집회 참가자들을 대상으로 정당하지 않게 사용되었으며 결국 이것이 백남기씨의 부상과 최종 사망에 이르게 한 원인이라고 지적했다. 

 

백남기씨의 사망 이후, 경찰은 가족들의 분명한 반대 의사에도 불구하고 백남기씨에 대한 부검을 실시하려 했다. 백남기씨의 시신을 지키기 위해 지지자들과 시민사회단체들은 40일동안 서울대학교 병원을 지켰다. 2016년 11월 18일, 백남기 투쟁본부와 백남기씨의 유가족들은 7명의 가해자들을  검찰에 고발했으며 여기에는 강신명 전 경찰청장, 구은수 전 서울경찰청장도 포함되어 있었다. 그러나 정부는 또 다시 어떠한 응답도 하지 않았다.

 

“국가 권력에 의한 과도한 공권력 사용은 즉시 그리고 독립적으로 조사되어야만 한다. 백남기씨의 죽음을 제대로 조사하지도 않고 심지어 사과도 하지 않은 것은 한국이 인권을 존중하고 촉진하며 보호하는 국가라고 주장할 수 없게 만든다. 문재인 대통령 당선자는 한국에서 국가폭력 책임자가 제대로 처벌받지 않고 있다는 인상을 주지 않도록 즉각 이 문제를 제기할 필요가 있다.”고 포럼아시아의 존 사무엘 사무총장은 말했다. 

 

공권력이 2015년 11월 15일 집회 참가자들을 향해 무차별적이고 정당성 없는 물대포를 사용한 것은 한국 및 국제 인권 기준을 위반한 것이다. 위해성 경찰장비의 사용 기준 등에 관한 규정 제13조와 살수차 운용지침은 가슴 아래로만 살수하도록 되어있고 집회 참가자가 부상을 당했을 경우 경찰은 즉각 응급처치를 제공해야 한다고 되어있다. 국제인권기준에 따르면 정부 당국은 ‘공무를 집행하기 위해 필요한 경우에만 무력을 사용할 수 있다’고 되어있으며 ‘평화로운 집회에 대해 무력을 사용해서는 안되고 만약 무력을 사용해야 한다면,무차별적이고 과도한 무력을 행사해서는 안된다’. 

 

포럼아시아는 문제인 대통령에게 국내 인권기준 및 국제 인권기준에 따라 백남기씨에게 일어난 일들에 대해 이전 정부가 제대로 대처하지 못한 것을 즉각 바로잡을 것을 촉구한다. 새 정부가 어떻게 인권 이슈를 다루는지에 따라 문재인 대통령 재임 기간 동안의 인권 기조를 구축할 수 있는 기회를 갖게 된다. 유가족들에게 공식적으로 사과하고, 철저하고 공정하며 독립적인 조사를 이행하며, 책임자들을 처벌하는 것은 훌륭한 출발점이 될 것이다. 

 

 

▣ 붙임문서 2. South Korea: President Moon Jae-in should prioritise investigation into death of Baek Nam-gi

 

(Bangkok, 10 May 2017) – As South Korea elected a new President yesterday, the Asian Forum for Human Rights and Development (FORUM-ASIA) calls on the new incoming President, Mr. Moon Jae-in, to conduct a thorough, impartial, and independent investigation into the death of Baek Nam-gi. A failure to do so would be a further discredit to the human rights track-record of the country.    

 

On 25 September 2016, Baek passed away after having been in a coma for 317 days. This had been caused by him being shot by a police’s water cannon on 14 November 2015 during the People’s Rally 2015 in Seoul, while protesting against the former Government. Despite widespread condemnation of what occurred and a continuous call for an independent investigation into what happened, among others by Maina Kiai, the then UN Special Rapporteur on the rights to freedom of peaceful assembly and of association, the former Government never issued an apology, let alone initiating an investigation. By rectifying this failure, President Moon Jae-in has an opportunity to restore the image of South Korea as a country that promotes and protects human rights. 

 

On 4-9 December 2015, FORUM-ASIA led a mission to Seoul to look into any breaches of law by authori-ties during the People’s Rally 2015 on 14 November 2015 and the Nationwide Rally for the Denunciation of State Violence and the Recovery of Baek Nam-gi on 5 December 2015. The delegation met with civil society organisations, journalists, lawyers, victims, a member of the National Assembly, and the National Human Rights Commission of Korea (NHRCK). The Mission concluded there was reason to fault authorities for human rights violations in the form of: the use of water cannon; the set-up of a bus barricade; and reprisals against assembly organisers and participants. The Mission also noted that there was indiscrimi-nate and unjustified use of water cannon against protesters, which resulted in the injuring and eventual passing of Baek. 

 

After his death, the police attempted to conduct an autopsy of Baek, against the explicit will of his family.  The Seoul National University Hospital was guarded by supporters and civil society groups for 40 days to prevent the police from taking his body. On 18 November 2016, the People’s Committee for Farmer Baek Nam-gi and Condemning State Violence and his family filed a complaint against seven alleged perpetrators, including the former National Police Agency Commissioner General, Kang Sin-myung and the former Seoul Metropolitan Police Agency Chief, Goo Eun-su. Again, there was no response from the Govern-ment.

 

‘The excessive use of force by authorities must be investigated promptly and independently. The failure to even apologise and lack of any steps taken to initiate an investigation into the death of Baek Nam-gi, is an embarrassment for a country like South Korea that claims to uphold, promote, and protect human rights. The President Moon Jae-in needs to address this immediately to eliminate the impression that im-punity is gaining ground in South Korea’, says John Samuel, Executive Director of FORUM-ASIA. 

 

The indiscriminate and unjustified use of water cannon against protesters on 14 November 2015 by the authorities is a violation of both domestic and international human rights standards. Article 13 of the Presidential Decree on Standards of the Usage of Lethal Force Equipment and Section Two of the Operational Instruction on Water Cannons states that a water cannon is only allowed to be used below the chest, and that when protesters are injured the police should immediately provide emergency aid. According to international human rights standards, authorities should ‘use force only when necessary and to the extent required for the performance of their duty’, and ‘should not resort to force during peaceful assemblies and ensure that where force is absolutely necessary, no one is subject to excessive or indiscriminate use of force’. 

 

FORUM-ASIA urges President Moon Jae-in to immediately rectify the failure of the former Government to handle what happened to Baek with respect and in accordance with national and international human rights standards. President Moon Jae-in will have an opportunity to set the tone for his Presidency on how his new Government will deal with human rights issues. Issuing a formal apology to the family and loved-ones of Baek, conducting a thorough, impartial and independent investigation, and bringing those responsible to justice, would be a great place to start.
