‘One-Man Rally’ Wins.

The Government should indemnify demonstrator for damage.

The Judge said that the prohibition of ‘one-man rally’ in front of the Blue House is illegal (Judged by Yoon Heung Ryul).

Last year, PSPD’s Free Information team identified that minute of major government agencies was not written sincerely and the sound recording is not conducted. As a result, the team started one-man rally for the preparation and disclosure of cabinet council minute. During this campaign, Choi hansu, coordinator of PSPD, was walked way off on June 26th, 2001,

The police justified this conduct for the following reasons: The sidewalk in front of the Blue House fountain is also in precinct of the Blue House. So the personal expression including one-man rally should be prohibited for the guidance of president.

Against the police’s positions, PSPD said the followings: The walking him way off by force is the violation of the human rights which is protected by the Constitution and laws. Basically, this conduct is also illegal because it is not based on criminal suit law.

In this case, Judgement was given for PSPD. The Judgement also said, “Walking him way off by policeman is illegal because one-man rally is not illegal”. This reference also assured that the Blue House is also the place that guarantees the freedom of expression.

Against the one-man rally, the police have applied to the Road Traffic Act and Misdemeanour Act for the inconvenience and popular complaints. By this judgement, this practice seemed to change in different direction.

Cha Byungjik, the attorney who is in charge of this case, said that after this judgement, the prohibition of one-man rally in front of government agency including the Blue House should be removed. The toxic clause of law concerning assembly and demonstration should be changed.
