밀양 주민들과 환경권 옹호자들에 대한 폭력적 탄압 규탄
밀양 송전탑 건설 의사결정 과정에 주민참여 보장 촉구
최근 밀양의 인권상황에 대한 국제사회의 우려가 이어지고 있다. 오늘(6/17) 방콕 소재 아시아 인권단체 포럼아시아(FORUM-ASIA)는 박근혜 대통령을 비롯하여 엄용수 밀양시장, 조환익 한국전력 사장, 현병철 국가인권위원회 위원장, 이성한 경찰청장에게 지난 6월 11일 밀양에서 발생한 폭력적인 행정대집행을 규탄하고 이로인한 인권 침해에 심각한 우려를 표명하는 공개서한을 발송했다.
포럼아시아는 공개서한을 통해 밀양 송전탑 건설 반대 농성장에 대한 행정대집행 과정에서 정부가 2,000여 명의 경찰 병력을 동원하여 고령의 주민들을 대상으로 강제적인 진압과 철거를 진행하였다는 사실에 대해 심각한 우려를 표명하고 이로 인해 발생한 주민 및 활동가들에 대한 심각한 인권 침해를 강력히 규탄했다. 포럼아시아는 지금이라도 이를 바로잡기 위해 △ 밀양 송전탑 공사 중단 및 주민들과의 대화 시작, △ 주민들의 평화로운 집회 자유의 권리 보장, △ 정부의 과잉폭력 중단, △ 인권침해자들에 대한 조사 및 가해자 처벌, △ 인권옹호자들에 대한 벌금 부과 중단 및 집회자유 규제에 대한 국제기준 준수를 요구하였다.
이미 지난해 10월 포럼아시아를 비롯한 국제인권단체들은 정부가 밀양 주민들과 환경활동가들을 공권력으로 위협하는 것은 개인의 정당한 권리를 억누르는 일이라고 지적하고 무차별적인 인권침해에 우려를 표명한 바 있다. 당시에도 포럼아시아는 대규모 개발 사업으로부터 피해를 입는 지역주민들이 반드시 해당 개발 사업의 모든 의사결정과정에 참여할 수 있어야 한다고 강조했으며, 이러한 과정이 없었다면 밀양 송전탑 건설은 중단되어야 한다고 지적했다. 마가렛 세카기야 유엔 인권옹호자 특별보고관 역시 지난해 한국을 공식 방문한 후 대규모 개발 사업에서 발생하는 인권침해에 대해 우려를 표한 바 있다.
이번 포럼아시아 서한은 밀양 송전탑 건설에 반대하는 주민과 활동가들에 대한 한국정부의 이번 조치가 국제 인권기준에 반하는 심각한 인권침해에 해당한다는 것을 다시 한번 지적해 주었다. 참여연대는 밀양 송전탑 건설의 문제점을 국제사회에 지속적으로 알려나갈 것이며 앞으로도 공권력의 부당한 인권침해에 침묵하지 않고 정부가 주민들과 진정성 있게 대화하고 평화적으로 문제를 해결할 때까지 국내외 연대의 끈을 놓지 않고 밀양 주민들의 싸움에 함께해 나갈 것이다.

The Honourable Park Geun-hye Phone: +82 (0)2 770 2372 Dear Madam President, Re: Condemn Crackdown on Miryang Protestors and Halt Construction Plans The Asian Forum for Human Rights and Development (FORUM-ASIA) writes to you to register our condemnation of the government’s latest violent crackdown on 11 June 2014 against environmental rights defenders as well as communities affected by the construction of high-voltage power transmission towers in Miryang. Gyeongsangnam-do Province, Republic of Korea. FORUM-ASIA deplores the disproportionate deployment and excessive use of force by around 2,000 law enforcement personnel against less than 100 elderly citizens residing in the community for exercising their legitimate right to freedom of peaceful assembly. The violent dispersal included the forceful dragging of protestors from and subsequent demolition of their encampments. We further regret that the violent actions resulted in around 20 casualties who required urgent medical attention. Despite the international outcry and condemnation that followed the initial crackdown in Miryang in October 2013, the government has not actively taken steps to address the grievances of the Miryang residents. Instead, the authorities issued an order demanding the complete withdrawal of protestors by 2 June 2014 before resuming construction. FORUM-ASIA reiterates that token offers of monetary compensatory are meaningless in the absence of genuine consultation and effective participation in decisions affecting the Miryang residents. FORUM-ASIA notes and deplores the recurring trend of reprisals against human rights defenders and protestors opposing large-scale development projects in the Republic of Korea. In addition, the continued arrests of protestors in Miryang, mostly on spurious grounds such as “obstruction of business” and “obstruction of justice”, further highlights serious shortcomings in the legal framework and a lack of protection mechanisms for defenders. This has also been highlighted in the report of the former United Nations Special Rapporteur on the situation of Human Rights Defenders, Madam Margaret Sekaggya, after her official visit to the Republic of Korea in 2013. We remind the Republic of Korea government of its obligations as a state party to the International Covenant on Civil and Political Rights to respect and protect the right to peaceful assembly as well as its recent commitment to the Human Rights Council to ensure a conducive environment for human rights defenders to carry out their work and the effective protection of their activities. We thus strongly urge the government of the Republic of Korea to: 1. Cease all powerline constructions in Miryang and establish avenues for dialogue and negotiation that ensure the right to effective and meaningful participation of people in all decision-making that affect their lives. Satisfy the process of free, prior, informed consent (FPIC) with the affected communities and conduct a thorough risk assessment before embarking on implementation of development projects. 2. Respect the right to freedom of peaceful assembly. Facilitate people’s creative expressions of grievance and protests with maximum tolerance. Refrain from imposing undue or arbitrary restrictions. 3. Refrain from using excessive force. Educate the police and strengthen the capacity of law enforcement and security agencies in human rights standards and crowd control such as the Code of Conduct for Law Enforcement Officials and the Basic Principles on the Use of Force and Firearms by Law Enforcement Officials. 4. Make rights violators accountable. Ensure independent and transparent investigations of human rights violations and abuses in the latest violent dispersal. Desist from providing immunity and do not perpetuate impunity among government officials and their instrumentalities. 5. Stop criminalization and imposition of heavy penalties, including all compensation lawsuits, against defenders and conduct a thorough review of laws that unduly restrict the exercise of the rights to freedoms of peaceful assembly, with a view to bring these laws into compliance with international standards.
