참여연대, 네덜란드 연기금 운영기관인 APG에『삼성반도체 기흥공장의 화학물질 관리실태와 문제점』보고서 발송
삼성반도체 공장에서 혈액암, 뇌종양, 희귀암 피해자가 잇따라 발생하면서 이와 관련된 원인과 책임에 대한 논란이 국내외적으로 제기되고 있다. 이러한 가운데 참여연대는 지난 9월 28일 참여연대, 좋은기업센터, 한국여성노동자회, 환경정의가 공동 발표한 『삼성반도체 기흥공장의 화학물질 관리 실태와 문제점』라는 제목의 이슈리포트를 오늘(12/16) APG(All Pension Group)에 발송했다. 참여연대는 APG가 UN PRI 원칙에 따라 투자기업의 윤리경영 모니터에 이 자료를 참고해 줄 것을 요청했다.
※ APG(All Pension Group)는 네덜란드 공무원 및 교원 연금 기금운용기관으로 공적 연기금운영기관 중 자산규모(3,150억, 2007년 말 기준)가 세계3위에 이름.
※ UN PRI(Principles for Responsible Investment)란 UN 코피아난 사무총장이 2006년 4월 뉴욕증권거래소에서 최초 공표한 책임투자원칙으로 투자의사결정시 전통적으로 중요시 되던 재무적인 측면뿐만 아니라 기업의 지속가능성에 영향을 미치는 비재무적인 요소(환경, 사회, 기업지배구조)를 동시에 고려하여 장기적인 관점으로 투자하는 방법을 말함.
APG는 UN PRI 원칙에 가입되어 있는 유럽 7곳의 기 관투자자와 함께 지난 5월 21일 최지성 삼성전자 사장에게 ‘삼성전자의 노동환경 안전정책과 실행에 관한 리뷰’라는 제목의 투자자 공동 질의서를 발송했었다. 그리고 공공 질의서를 통해 삼성 전자 백혈병에 대해 제3의 컨소시엄을 구성해 역학조사를 하겠다는 삼성전자 입장 관련해서 ▶ 언제부터 계획을 이행할 것인지 ▶ 조사결과를 어떻게 다룰 것인지 ▶ 조사결과를 투자자들과 언론에 어느 수준까지 공개할 것인지 ▶ 현재 투병중인 전직 노동자들을 위한 의료적 지원 등 대책이 있는지 ▶ 노동자들에 대한 적절한 교육이 이뤄지고 있는지 ▶ 전체적인 작업안전관리가 효율적으로 이뤄지고 있는지 등에 대해서 답변을 요구한바 있다.
참여연대가 APG에 발송한 이슈리포트는 참여연대가 제보 받은 서울대의 『삼성전자 기흥공장의 화학물질 노출평가 자문 보고서』를 토대로 ‘기흥공장의 화학물질 사용현황 및 문제점, 작업환경측정의 문제점, 가스검지기 설치 현황 및 문제점’을 정리한 것이다. 자문보고서는 서울대가 삼성전자, 하이닉스, 엠코테크놀로지코리아의 의뢰를 받아 지난해 6월부터 9월까지 해당 반도체 3사의 6개 공장을 대상으로 진행한 ‘반도체 사업장 위험성 평가 자문 보고서’ 중 삼성전자 기흥공장 화학물질 노출관리에 해당하는 것으로 그간 그 내용이 비 공개되어왔다.
이 보고서에 따르면 삼성전자 기흥공장에서 사용 중인 상당수의 화학물질 성분이 파악 안 되고, 가스누출이 빈번하게 일어나는 등 화학물질 관리에 문제가 있었던 것으로 드러났다.
시민단체들은 2007년부터 논란이 되고 있는 삼성전자 백혈병 문제를 해결하고, 더 나아가 반도체 산업 노동자들의 생명과 건강을 보호하기 위해서 삼성전자에게 첫째, 삼성은 백혈병 등 직업병 피해를 인정하고, 문제 해결을 위한 사회적 책임을 다할 것 둘째, 투병중인 노동자와 유가족들에게 합당한 보상과 작업환경을 개선할 것 셋째, 자체 역학조사 진행과정을 투명하게 공개할 것을 요구하고 있다. 또한 정부에게는 산업재해를 인정하고, 신뢰성 있는 진상 조사 및 관련 제도 개정에 적극적으로 나설 것과 국회에는 국가차원의 신뢰성 있는 진상조사를 실시할 수 있도록 강제하고, 산업재해 및 화학물질 관리에 대한 제도개선을 요구하고 있다.
한편 APG는 참여연대, 좋은기업센터, 한국여성노동자회, 환경정의가 공동 발표한『삼성반도체 기흥공장의 화학물질 관리 실태와 문제점』 이슈리포트를 지난 5월 21일 삼성전자 공동 질의에 참여한 다른 기관투자자들에게도 전달하겠다고 밝혔다.
PSPD Sent the Report on the Chemical Exposure Control at the Samsung Electronics’ Semiconductor Plant in Giheung to the APG
The increasing number of victims of leukemia, brain tumors, and other rare cancers in Samsung semiconductor factory in Korea has been provoking a debate on the causes and social responsibility for such industrial disasters. In the middle of such debate, four Korean NGOs, People’s Solidarity for Participatory Democracy (PSPD), Corporate for All, Korean Women Workers Association, and Environmental Justice disclosed the report on 『Problems of Chemical Exposure Control at the Samsung Electronics’ Semiconductor Plant in Giheung』on September 28th, 2010, and PSPD sent the report to All Pensions Group (APG) of the Netherlands on December 16th, 2010. PSPD called on APG to take the report into consideration for monitoring ethical management based on the UN PRI (Principle of Responsible Investment).
※APG (All Pensions Group) is a Dutch organization that administers the collective pension scheme for the government and educational sectors. The asset size is 315 billion as of 2007 and reaches world number three.
※UN PRI (Principles of Responsible Investment) is a set of guidelines for investors wishing to address environmental, social, and corporate governance (ESG) issues. PRI should be considered alongside more traditional financial factors for long-term sustainable performance of corporations. The principles were launched by the secretary-general of the United Nations, Kofi Annan at the New York Stock Exchange in April 2006.
On May 21, 2010, APG and seven European institutional investors under the UN PRI had sent an inquiry letter to Samsung Electronics in response to Samsung Electronics’ announcement on the leukemia cases in Samsung Electronics that it would form a third-party-consortium to carry out an epidemiological survey and raised six questions about ▶when the company would implement their plan ▶what the company would do with the results of the survey ▶to what extent they would open the results to the media and investors ▶whether they provided medial support to their ailing former employees ▶whether they provide appropriate employee trainings, and ▶the efficiency of the whole workplace safety control.
The report sent by PSPD pointed out problems based on the Advisory Report of 『the Chemical Exposure Control at Samsung Semiconductors Plant』by Seoul National University as follows: the chemical use and its problems, the problems of the working environment assessment, and the installation of gas detectors and related problems in the Giheung plant. Seoul National University conducted an epidemiological survey to measure the level of risks in semiconductor plants in six plants of the three semiconductor companies – Samsung Electronics, Hynix and Amkor Technology Korea for the period of June to September in 2009. The advisory report that analyzes the management of the chemical exposure in Samsung Giheung plant was not disclosed so far.
The report presented that the serious flaws of Samsung Electronics’ chemical control such as many cases of unidentified chemicals and the gas leak rate beyond the exposure limits
Korean NGOs urge Samsung Electronics that △the cases of employees contracting leukemia at Samsung Electronics should be recognized as occupational diseases and they should take responsibilities for the solution, ►the ailing workers and the families of the deceased should be given appropriate compensations, and a better workplace environment should be provided, ►they should open the proceedings of the epidemiological survey to the public to iron out the leukemia cases in Samsung Electronics argued since 2007 and go on farther protecting lives and health of the workers in the semiconductor industry. Meanwhile, they require ►the government should recognize the cases as industrial accidents, make thorough investigations and amend related laws without hesitation, ►the National Assembly should force the government to carry out a reliable investigation of the case amend laws concerning industrial accidents and chemical control.
Meanwhile, APG says they are going to address the issue report 『Problems of Chemical Exposure Control at the Samsung Electronics’ Semiconductor Plant in Giheung』 issued by PSPD, Corporate for All, Korean Women Workers Association, and Environmental Justice to other institutional investors that jointly took parts in an inquiry of Samsung Electronics on May 21st.
