국제인권단체인 Human Rights Watch가 미군의 범행으로 추정되는 수십명의 이라크 사망사건에 대한 보고서를 내던 날, BBC 특파원은 가장 비극적이고 끔찍한 사건의 생존자들을 방문했다.

정밀 조사결과 아딜 카바즈의 차(흰색 브라질산 폭스바겐 파사트)에 큰 참사가 있었다는 것이 분명해졌다. 아딜의 처남인 알리 야와드는 담요를 들어보이며, 8월 7일 미군 제1 기갑사단의 병사들이 경고 없이 그들의 차를 향해 일제사격을 가한 야만적인 흔적을 보여주었다. 폭스바겐의 차체는 20발도 넘는 총알 구멍으로 완전히 망가졌으며 그 내부는 깨진 유리조각으로 가득 차 있었다.

오래된 혈흔은 말라붙어버렸지만, 아딜이 중상을 입은 운전자석과 그의 딸 올라(14)와 아들 하이다르(19)가 죽은 뒷자석에서 검붉은 핏자국들을 분명히 확인할 수 있었다. 아딜의 또 다른 딸 미르바트(8)는 아딜처럼 상처를 입어 약 4시간 뒤에 미군에 의해 병원에 옮겨졌으나 결국 숨을 거두고 말았다.

유일한 생존자들

알리는 차 트렁크를 열어 아딜이 당시 입고 있었던 피가 굳어 딱딱해진 체크무늬의 셔츠와 검붉은 얼룩으로 뒤덮인 만화 캐릭터와 꽃이 새겨진 미르바트의 티셔츠를 꺼내 들었다. 뒷 자석의 선반에는 고개를 끄덕거리는 강아지 인형이 총알에 의해 머리가 날라간 것처럼 보였다.

우연히 미군 지역으로 들어간 후 그 가족들에게 가해진 총알세례로부터 살아남은 건 오직 아이들의 어머니인 안와르 야와드와 다른 또 한명의 딸 하딜(14) 뿐이었다. 현재 안와르와 하딜은 그들의 집에서 안와르 부모님과 함께 지내고 있다. 이라크 관습에 따라 안와르의 부모님은 그녀의 집에서 영구히 함께 살게 되는 것이다.

그 사건이 있은 후 일주일 뒤에 안와르는 아기를 낳았고, 그 작은 아기는 할머니의 팔에 안전하게 안겨있다. 모든 집안의 여자들은 검은 옷을 입고 있고, 그들은 일년 동안 그 옷을 입고 있어야 한다.

하딜은 우리 특파원들의 방문 내내 침묵을 지켰다. 반면, 안와르는 꿋꿋하게 그 끔찍한 사건에 대해 말해주었으며, 그녀의 막내 딸이 당한 부상 부분에 이르러서만 흐느껴 울며 주저 앉았다.

법적 요구

흑인 미군 병사가 차에서 하딜을 끌어낼 때 그 옆에는 파편에 의해 잘려나간 하딜의 팔이 있었다는 진술을 할 때, 안와르에게서 차가운 증오심을 느낄 수 있었다. 이제 미군 병사들을 볼 때, 두렵지 않느냐는 나의 질문에 그녀는 “당신이 나와 같은 경험을 한다면, 당신이 느낄 수 있는 두려움이란 오직 전능하신 신 뿐이다”라고 대답했다.

비록 방의 한쪽에서는 알자지라(al-Jazeera) 방송이 흘러나오고 있었지만, 안와르는 HRW가 그녀의 이야기를 중점적으로 다룬 보고서를 간행했다는 것도 모르고 있었다. 또한 방송과 HRW가 연합군 사령관 산체스의 직접 지시로 제1 기갑부대로부터 11,000달러를 받게 될 것이라고 말했지만, 미군으로부터 보상금이 나올 것이라는 것도 몰랐다.

그녀는 그녀의 가족들이 그 사건에 대해 어떠한 사과도 받지 못했으며, 연합국 군인들은 군사작전 중에 민간인 사망자가 생긴다 해도 기소되지 않는다는 것을 들었다고 말했다.

그러나 그녀는 이라크 법원에서 한 변호사가 이 사건을 진행시키고 있다고 말했다.

불 꺼진 거리

아딜은 통금 2시간 전, 야와드의 집을 나와 가족과 함께 집으로 돌아가고 있었는데 동쪽으로부터 약 2 Km떨어진 지점에서 그들은 공격을 당했다. 안와르는 그들이 본 것이라고는 마지막 순간에 불 꺼진 도로를 막고 있는 두 대의 짙녹색 험비(Humvee) 뿐이었으며 그들의 차가 접근하자 군인들은 경고도 없이 총을 쏘아대기 시작했다고 말했다. 또한 그 총격은 약 10분 동안이나 지속되었다고 한다.

그날 저녁, 그 군인들은 거의 똑같은 지점에서 사이프 알 아자비와 그의 두 친구들이 라디오를 크게 켠 채로 그 주변을 빠르게 운전하며 지나갈 때 총격을 가해, 사이프 알 아자비는 사망했다. 사이프의 시신은 차가 공격에 의해 불이 붙어 함께 타서 없어졌다.

이 모든 사건은 바로 야비르 집 밖에서 일어났다. 그 가족들은 군인들이 무기를 찾기 위해 주변의 집을 조사할 때 발생한 대혼란의 무질서한 장면들에 대해 진술했다.

“미군들은 공황상태에 빠진 것처럼 보였다. 공격 당한 그 두 대의 차 뿐만이 아니라 그들은 무차별적으로 그들 주변의 모든 것에 총격을 가했으며, 나는 누군가 영어로 소리치는 것도 들었다. ‘움직이는 것은 모두 다 쏴버려’.. 그들은 심지어 서로를 향해 발사하기도 했다. 그들 중 두 명은 비명을 지르며 길에 쓰러져 있었다.”고 그 사건을 목격한 알리 야부리는 말했다. 다른 누군가가 총을 쏜 것 같지 않았다며 그는 덧붙였다.

상반되는 진술

알리는 그의 정원의 벽, 문 그리고 그 군인들이 다양한 각도로 총을 난사했다는 것을 증명하는 듯한 그의 집에 박힌 수많은 총알자국들을 가리켰다. 그러나 대체적으로 이라크인들의 증언은 연합군의 증언과 상이한 측면이 많다. HRW가 보도한 연합군의 조사결과는 ‘그날 저녁 알 슬라이크에서 애석한 사건이 발생했으나, 군인들은 교전 규칙에 따라 그 범위 내에서 대응했다’ 뿐이었다. 그 사건 당시 연합군 대변인은 그 부대는 이미 작전 중 공격을 받고 있었고 연합군 내의 총격 사건은 없었다고 말했다.

안와르는 “오직 신만이 왜 그들이 우리에게 총격을 가했는지 아신다. 나는 지난 4월 그들이 들어와 사담 후세인 정권을 무너뜨렸을 때 행복했었다. 그러나 나는 지금 그들을 경멸한다.”라고 말했다.

Case study: Iraqi civilian deaths

On the day Human Rights Watch publishes a report on the suspected killings of dozens of Iraqi civilians by the American army, our correspondent visits survivors of one the most tragic and disturbing cases.

To drivers speeding along the main north-south highway through Baghdad, it just looks like a car under a protective cover parked outside a modest house in al-Slaikh district.

It’s only on closer inspection that the calamity that occurred in Adil Kawwaz’s white Brazilian-built Volkswagen Passat becomes clear. Adil’s brother-in-law Ali Jawad lifts up the blanket to reveal the savage effects of a sustained volley from members of the US Army 1st Armored Division who opened fire without warning on the car on the evening of 7 August.

The bodywork is punctured by more than 20 bullet holes and broken glass fills the inside. The blood has long dried out, but you can see clearly the dark patches where Adil received his fatal wounds in the driver’s seat, and where his daughter Ola, 14, and son Haidar, 19, died where they were seated in the back. Another daughter, Mirvat, who was 8, died of her wounds – like Adil himself – before being delivered to hospital by the American troops about four hours later.

Only survivors

Opening the boot, Ali brings out a chequered shirt, stiff with dried blood that Adil had been wearing, and Mirvat’s tee-shirt, a pattern of cartoon characters and flowers still visible under the dark stains. On the ledge behind the back seat, a toy nodding dog appears to have had its head blown off by one of the high velocity rounds.

Only the children’s mother, Anwar Jawad, and another daughter, 14-year-old Hadil, survived the onslaught, which was unleashed on the family after they drove unwittingly up to an American roadblock.

Inside the house, Anwar and Hadil are spending the day at the mother’s parents. They live permanently with Adil’s family in accordance with the custom here.

Anwar gave birth a week after the shooting and the little baby, Hassan, is held protectively in his grandmother arms. All the women wear black and will continue to do so until a year has passed.

Hadil remains silent during our entire visit, but Anwar retells with great fortitude the terrible events – breaking down only when she comes to the injuries she saw on her youngest daughter.

Legal claims

But there’s cold hatred when she alleges that an African American soldier had dragged Hadil from the car by her arm just where it had been cut by shrapnel.

“When you have been through an experience like that the only thing you fear is God Almighty,” she says, when I ask whether she is now afraid when she sees US troops.

Although al-Jazeera television is on in the corner of the room, Anwar does not know Human Rights Watch has published its report today in which her story figures prominently.

Nor is she forthcoming about the issue of compensation from the US troops, though media reports and HRW say the family has received $11,000 from 1st Armored Division coffers on the direct orders of Lt Gen Ricardo Sanchez, commander of coalition forces in Iraq.

What she does say is that the family has never received an apology for the incident and they have been told that coalition soldiers are immune from prosecution in cases like these when civilian deaths occur during military operations.

A lawyer is pursuing the case through the Iraqi courts, however, she says.

Unlit street

The car was hit about a kilometre to the east, as Adil was driving his family back home from a visit to the Jawad’s two hours before curfew. Anwar says they only saw the two dark green Humvees blocking the unlit road at the last second and the soldiers opened fire without warning as the white Passat approached. The shooting went on for about 10 minutes, she says.

That evening troops also shot dead Saif al-Azawi at almost the same spot, as he and two friends were driving fast through the neighbourhood with the radio blaring.

Saif’s body was incinerated as the car he was driving caught fire after being hit.

It all happened just outside the Jabari household. Members of the family talk of a scene of chaos breaking out as the troops were searching a nearby house for weapons. “The Americans seemed to panic,” said Ali Jaburi, who witnessed the events. “As well as the two cars that were hit, they fired indiscriminately all around them. I heard someone shout in English: ‘Shoot anything that moves’. They even shot each other. Two of them were laying screaming in the road,” says Ali.

There was no indication anyone else opened fire, he adds.

Contradictory accounts

Ali points out a number of bullet marks on his garden wall, gate, and on the house itself that seem to confirm that troops opened fire in different directions. But broadly speaking Iraqi eyewitness accounts are at odds with the Coalition’s version of events.

A military investigation reported by HRW found that a “regrettable incident” took place in al-Slaikh that evening, but troops “acted within the rules of engagement”.

Coalition military spokesmen at the time of the incident said the troops had already come under attack during their operation. There are no reports of friendly fire incidents.

“Only God knows why they opened fire on us like that,” says Anwar. “I was happy when the troops came in April and ousted Saddam Hussein, but now I think they are scum.”
