핵무기의비확산에관한조약(NPT)



본 조약을 체결하는 국가들(이하 “조약당사국”이라 칭한다)은,


핵전쟁이 모든 인류에게 엄습하게 되는 참해와 그러한 전쟁의 위험을 회피하기 위하여
모든 노력을 경주하고 제 국민의 안전을 보장하기 위한 조치를 취하여야 할 필연적 필요성을 고려하고,


핵무기의 확산으로 핵전쟁의 위험이 심각하게 증대할 것임을 확신하며,


핵무기의 광범한 분산방지에 관한 협정의 체결을 요구하는 국제연합총회의 제결의에 의거하며, 평화적 원자력 활동에 대한 국제원자력기구의 안전조치 적용을 용이하게 하는데 협조할 것임을 약속하며,


어떠한 전략적 장소에서의 기재 및 기타 기술의 사용에 의한 선원물질 및 특수분열성물질의 이동에 대한 효과적 안전조치 적용원칙을 국제원자력기구의 안전조치제도의 테두리내에서, 적용하는 것을 촉진하기 위한 연구개발 및 기타의 노력에 대한 지지를 표명하며,


핵폭발장치의 개발로부터 핵무기 보유국이 인출하는 기술상의 부산물을 포함하여 핵기술의 평화적 응용의 이익은, 평화적 목적을 위하여 핵무기 보유국이거나 또는 핵무기 비보유국이거나를 불문하고 본 조약의 모든 당사국에 제공되어야 한다는 원칙을 확인하며,


상기원칙을 촉진함에 있어서 본 조약의 모든 당사국은 평화적 목적을 위한 원자력의 응용을 더욱 개발하기 위한 과학정보의 가능한 한 최대한의 교환에 참여할 권리를 가지며 또한 단독으로 또는 다른 국가와 협조하여 동 응용의 개발에 가일층 기여할 수 있음을 확신하며,


가능한 한 조속한 일자에 핵무기 경쟁의 중지를 성취하고 또한 핵군비축소의 방향으로 효과적인 조치를 취하고자 하는 당사국의 의사를 선언하며,


이러한 목적을 달성함에 있어 모든 국가의 협조를 촉구하며,


대기권, 외기권 및 수중에서의 핵무기 실험을 금지하는 1963년 조약 당사국들이, 핵무기의 모든 실험폭발을 영원히 중단하도록 노력하고 또한 이러한 목적으로 교섭을 계속하고자 동 조약의 전문에서 표명한 결의를 상기하며,


엄격하고 효과적인 국제감시하의 일반적 및 완전한 군축에 관한 조약에 따라 핵무기의 제조 중지, 모든 현존 핵무기의 비축 해소 및 국내 병기고로부터의 핵무기와 핵무기 운반수단의 제거를 용이하게 하기 위하여 국제적 긴장완화와 국가간의 신뢰증진을 촉진하기를 희망하며,
국제연합헌장에 따라 제국가는, 그들의 국제관계에 있어서 어느 국가의 영토보전과 정치적 독립에 대하여 또는 국제연합의 목적과 일치하지 아니하는 여하한 방법으로 무력의 위협 또는 무력사용을 삼가해야 하며 또한 국제평화와 안전의 확립 및 유지는 세계의 인적 및 경제적 자원의 군비목적에의 전용을 최소화함으로써 촉진될 수 있다는 것을 상기하여,


다음과 같이 합의하였다.


제 1 조


핵무기보유 조약당사국은 여하한 핵무기 또는 기타의 핵폭발장치 또는 그러한 무기 또는 폭발장치에 대한 관리를 직접적으로 또는 간접적으로 어떠한 수령자에 대하여도 양도하지 않을 것을 약속하며, 또한 핵무기 비보유국이 핵무기 또는 기타의 핵폭발장치를 제조하거나 획득하며 또는 그러한 무기 또는 핵폭발장치를 관리하는 것을 여하한 방법으로도 원조, 장려 또는 권유하지 않을 것을 약속한다.


제 2 조


핵무기 비보유 조약당사국은 여하한 핵무기 또는 기타의 핵폭발장치 또는 그러한 무기 또는 폭발장치의 관리를 직접적으로 또는 간접적으로 어떠한 양도자로부터도 양도받지 않을 것과, 핵무기 또는 기타의 핵폭발장치를 제조하거나 또는 다른 방법으로 획득하지 않을 것과 또한 핵무기 또는 기타의 핵폭발장치를 제조함에 있어서 어떠한 원조를 구하거나 또는 받지 않을 것을 약속한다.


제 3 조


1. 핵무기 비보유 조약당사국은 원자력을, 평화적 이용으로부터 핵무기 또는 기타의 핵폭발장치로 전용하는 것을 방지하기 위하여 본 조약에 따라 부담하는 의무이행의 검증을 위한 전속적 목적으로 국제원자력기구규정 및 동 기구의 안전조치제도에 따라 국제원자력기구와 교섭하여 체결할 합의사항에 열거된 안전조치를 수락하기로 약속한다. 본조에 의하여 요구되는 안전조치의 절차는 선원물질 또는 특수분열성물질이 주요원자력시설내에서 생산처리 또는 사용되고 있는가 또는 그러한 시설외에서 그렇게 되고 있는가를 불문하고, 동 물질에 관하여 적용되어야 한다. 본조에 의하여 요구되는 안전조치는 전기당사국 영역내에서나 그 관할권하에서나 또는 기타의 장소에서 동 국가의 통제하에 행하여지는 모든 평화적 원자력 활동에 있어서의 모든 선원물질 또는 특수분열성물질에 적용되어야 한다.


2. 본 조약 당사국은, 선원물질 또는 특수분열성물질이 본조에 의하여 요구되고 있는 안전조치에 따르지 아니하는 한, (가) 선원물질 또는 특수분열성물질 또는 (나) 특수분열성물질의 처리사용 또는 생산을 위하여 특별히 설계되거나 또는 준비되는 장비 또는 물질을 평화적 목적을 위해서 여하한 핵무기보유국에 제공하지 아니하기로 약속한다.


3. 본조에 의하여 요구되는 안전조치는, 본 조약 제4조에 부응하는 방법으로, 또한 본조의 규정과 본 조약 전문에 규정된 안전조치 적용원칙에 따른 평화적 목적을 위한 핵물질의 처리사용 또는 생산을 위한 핵물질과 장비의 국제적 교환을 포함하여 평화적 원자력 활동분야에 있어서의 조약당사국의 경제적 또는 기술적 개발 또는 국제협력에 대한 방해를 회피하는 방법으로 시행되어야 한다.


4. 핵무기 비보유 조약당사국은 국제원자력기구규정에 따라 본조의 요건을 충족하기 위하여 개별적으로 또는 다른 국가와 공동으로 국제원자력기구와 협정을 체결한다. 동 협정의 교섭은 본 조약의 최초 발효일로부터 180일이내에 개시되어야 한다. 전기의 180일 후에 비준서 또는 가입서를 기탁하는 국가에 대해서는 동 협정의 교섭이 동 기탁일자 이전에 개시되어야 한다. 동 협정은 교섭개시일로부터 18개월 이내에 발효하여야 한다.


제 4 조


1. 본 조약의 어떠한 규정도 차별없이 또한 본 조약 제1조 및 제2조에 의거한 평화적 목적을 위한 원자력의 연구생산 및 사용을 개발시킬 수 있는 모든 조약당사국의 불가양의 권리에 영향을 주는 것으로 해석되어서는 아니된다.


2. 모든 조약당사국은 원자력의 평화적 이용을 위한 장비 물질 및 과학기술적 정보의 가능한 한 최대한의 교환을 용이하게 하기로 약속하고, 또한 동 교환에 참여할 수 있는 권리를 가진다. 상기의 위치에 처해 있는 조약당사국은, 개발도상지역의 필요성을 적절히 고려하여, 특히 핵무기 비보유 조약당사국의 영역내에서, 평화적 목적을 위한 원자력 응용을 더욱 개발하는데 단독으로 또는 다른 국가 및 국제기구와 공동으로 기여하도록 협력한다.


제 5 조


본 조약 당사국은 본 조약에 의거하여 적절한 국제감시하에 또한 적절한 국제적 절차를 통하여 핵폭발의 평화적 응용으로부터 발생하는 잠재적 이익이 무차별의 기초위에 핵무기 비보유 조약당사국에 제공되어야 하며, 또한 사용된 폭발장치에 대하여 핵무기 비보유 조약당사국이 부담하는 비용은 가능한 한 저렴할 것과 연구 및 개발을 위한 어떠한 비용도 제외할 것을 보장하기 위한 적절한 조치를 취하기로 약속한다. 핵무기 비보유 조약당사국은 핵무기 비보유국을 적절히 대표하는 적당한 국제기관을 통하여 특별한 국제협정에 따라 그러한 이익을 획득할 수 있어야 한다. 이 문제에 관한 교섭은 본 조약이 발효한 후 가능한 한 조속히 개시되어야 한다. 핵무기 비보유 조약당사국이 원하는 경우에는 양자협정에 따라 그러한 이익을 획득할 수 있다.


제 6 조


조약당사국은 조속한 일자내에 핵무기 경쟁중지 및 핵군비 축소를 위한 효과적 조치에 관한 교섭과 엄격하고 효과적인 국제적 통제하의 일반적 및 완전한 군축에 관한 조약 체결을 위한 교섭을 성실히 추구하기로 약속한다.


제 7 조


본 조약의 어떠한 규정도 국가의 집단이 각자의 영역내에서 핵무기의 전면적 부재를 보장하기 위하여 지역적 조약을 체결할 수 있는 권리에 영향을 주지 아니한다.


제 8 조


1. 조약당사국은 어느 국가나 본 조약에 대한 개정안을 제의할 수 있다. 제의된 개정문안은 기탁국 정부에 제출되며 기탁국 정부는 이를 모든 조약당사국에 배부한다. 동 개정안에 대하여 조약당사국의 3분의 1 또는 그 이상의 요청이 있을 경우에, 기탁국 정부는 동 개정안을 심의하기 위하여 모든 조약당사국을 초청하는 회의를 소집하여야 한다.


2. 본 조약에 대한 개정안은, 모든 핵무기 보유 조약당사국과 동 개정안이 배부된 당시의 국제원자력기구 이사국인 조약당사국 전체의 찬성을 포함한 모든 조약당사국의 과반수의 찬성투표로써 승인되어야 한다. 동 개정안은 개정안에 대한 비준서를 기탁하는 당사국에 대하여, 모든 핵무기 보유 조약당사국과 동 개정안이 배부된 당시의 국제원자력기구 이사국인 조약당사국 전체의 비준서를 포함한 모든 조약당사국 과반수의 비준서가 기탁된 일자에 효력을 발생한다. 그 이후에는 동 개정안에 대한 비준서를 기탁하는 일자에 동 당사국에 대하여 효력을 발생한다.


3. 본 조약의 발효일로부터 5년이 경과한 후에 조약당사국회의가 본 조약 전문의 목적과 조약규정이 실현되고 있음을 보증할 목적으로 본 조약의 실시를 검토하기 위하여 스위스 제네바에서 개최된다. 그 이후에는 5년마다 조약당사국 과반수가 동일한 취지로 기탁국 정부에 제의함으로써 본 조약의 실시를 검토하기 위해 동일한 목적의 추후 회의를 소집할 수 있다.


제 9 조


1. 본 조약은 서명을 위하여 모든 국가에 개방된다. 본조 3항에 의거하여 본 조약의 발효전에 본 조약에 서명하지 아니한 국가는 언제든지 본 조약에 가입할 수 있다.


2. 본 조약은 서명국에 의하여 비준되어야 한다. 비준서 및 가입서는 기탁국 정부로 지정된 미합중국, 영국 및 소련 정부에 기탁된다.
3. 본 조약은 본 조약의 기탁국 정부로 지정된 국가 및 본 조약의 다른 40개 서명국에 의한 비준과 동 제국에 의한 비준서 기탁일자에 발효한다. 본 조약상 핵무기 보유국이라 함은 1967년 1월 1일 이전에 핵무기 또는 기타의 핵폭발장치를 제조하고 폭발한 국가를 말한다.


4. 본 조약의 발효후에 비준서 또는 가입서를 기탁하는 국가에 대해서는 동 국가의 비준서 또는 가입서 기탁일자에 발효한다.


5. 기탁국 정부는 본 조약에 대한 서명일자, 비준서 또는 가입서 기탁일자, 본 조약의 발효일자 및 회의소집 요청 또는 기타의 통고접수일자를 모든 서명국 및 가입국에 즉시 통보하여야 한다.


6. 본 조약은 국제연합헌장 제102조에 따라 기탁국 정부에 의하여 등록된다.


제 10 조


1. 각 당사국은, 당사국의 주권을 행사함에 있어서, 본 조약상의 문제에 관련되는 비상사태가 자국의 지상이익을 위태롭게 하고 있음을 결정하는 경우에는 본 조약으로부터 탈퇴할 수 있는 권리를 가진다. 각 당사국은 동 탈퇴 통고를 3개월전에 모든 조약당사국과 국제연합 안전보장이사회에 행한다. 동 통고에는 동 국가의 지상이익을 위태롭게 하고 있는 것으로 그 국가가 간주하는 비상사태에 관한 설명이 포함되어야 한다.


2. 본 조약의 발효일로부터 25년이 경과한 후에 본 조약이 무기한으로 효력을 지속할 것인가 또는 추후의 일정기간동안 연장될 것인가를 결정하기 위하여 회의를 소집한다. 동 결정은 조약당사국 과반수의 찬성에 의한다.


제 11 조


동등히 정본인 영어, 노어, 불어, 서반아어 및 중국어로 된 본 조약은 기탁국 정부의 문서보관소에 기탁된다. 본 조약의 인증등본은 기탁국 정부에 의하여 서명국과 가입국 정부에 전달된다.


이상의 증거로서 정당히 권한을 위임받은 하기 서명자는 본 조약에 서명하였다.


1968년 7월 1일 워싱턴, 런던 및 모스크바에서 본 협정문 3부를 작성하였다.







Treaty on the Non-Proliferation of Nuclear Weapons

The States concluding this Treaty, hereinafter referred to as the “Parties to the Treaty”,


Considering the devastation that would be visited upon all mankind by a nuclear war and the consequent need to make every effort to avert the danger of such a war and to take measures to safeguard the security of peoples,


Believing that the proliferation of nuclear weapons would seriously enhance the danger of nuclear war,


In conformity with resolutions of the United Nations General Assembly calling for the conclusion of an agreement on the prevention of wider dissemination of nuclear weapons,


Undertaking to co-operate in facilitating the application of International Atomic Energy Agency safeguards on peaceful nuclear activities,


Expressing their support for research, development and other efforts to further the application, within the framework of the International Atomic Energy Agency safeguards system, of the principle of safeguarding effectively the flow of source and special fissionable materials by use of instruments and other techniques at certain strategic points,


Affirming the principle that the benefits of peaceful applications of nuclear technology, including any technological by-products which may be derived by nuclear-weapon States from the development of nuclear explosive devices, should be available for peaceful purposes to all Parties to the Treaty, whether nuclear-weapon or non-nuclear-weapon States,


Convinced that, in furtherance of this principle, all Parties to the Treaty are entitled to participate in the fullest possible exchange of scientific information for, and to contribute alone or in co-operation with other States to, the further development of the applications of atomic energy for peaceful purposes,


Declaring their intention to achieve at the earliest possible date the cessation of the nuclear arms race and to undertake effective measures in the direction of nuclear disarmament,


Urging the co-operation of all States in the attainment of this objective,


Recalling the determination expressed by the Parties to the 1963 Treaty banning nuclear weapon tests in the atmosphere, in outer space and under water in its Preamble to seek to achieve the discontinuance of all test explosions of nuclear weapons for all time and to continue negotiations to this end,


Desiring to further the easing of international tension and the strengthening of trust between States in order to facilitate the cessation of the manufacture of nuclear weapons, the liquidation of all their existing stockpiles, and the elimination from national arsenals of nuclear weapons and the means of their delivery pursuant to a Treaty on general and complete disarmament under strict and effective international control,


Recalling that, in accordance with the Charter of the United Nations, States must refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any State, or in any other manner inconsistent with the Purposes of the United Nations, and that the establishment and maintenance of international peace and security are to be promoted with the least diversion for armaments of the world’s human and economic resources,


Have agreed as follows:


Article I


Each nuclear-weapon State Party to the Treaty undertakes not to transfer to any recipient whatsoever nuclear weapons or other nuclear explosive devices or control over such weapons or explosive devices directly, or indirectly; and not in any way to assist, encourage, or induce any non-nuclear-weapon State to manufacture or otherwise acquire nuclear weapons or other nuclear explosive devices, or control over such weapons or explosive devices.


Article II


Each non-nuclear-weapon State Party to the Treaty undertakes not to receive the transfer from any transferor whatsoever of nuclear weapons or other nuclear explosive devices or of control over such weapons or explosive devices directly, or indirectly; not to manufacture or otherwise acquire nuclear weapons or other nuclear explosive devices; and not to seek or receive any assistance in the manufacture of nuclear weapons or other nuclear explosive devices.


Article III


1. Each non-nuclear-weapon State Party to the Treaty undertakes to accept safeguards, as set forth in an agreement to be negotiated and concluded with the International Atomic Energy Agency in accordance with the Statute of the International Atomic Energy Agency and the Agency’s safeguards system, for the exclusive purpose of verification of the fulfillment of its obligations assumed under this Treaty with a view to preventing diversion of nuclear energy from peaceful uses to nuclear weapons or other nuclear explosive devices. Procedures for the safeguards required by this Article shall be followed with respect to source or special fissionable material whether it is being produced, processed or used in any principal nuclearfacility or is outside any such facility. The safeguards required by this Article shall be applied on all source or special fissionable material in all peaceful nuclear activities within the territory of such State, under its jurisdiction, or carried out under its control anywhere.


2. Each State Party to the Treaty undertakes not to provide: (a) source or special fissionable material, or (b) equipment or material especially designed or prepared for the processing, use or production of special fissionable material, to any non-nuclear-weapon State for peaceful purposes, unless the source or special fissionable material shall be subject to the safeguards required by this Article.
3. The safeguards required by this Article shall be implemented in a manner designed to comply with Article IV of this Treaty, and to avoid hampering the economic or technological development of the Parties or international co-operation in the field of peaceful nuclear activities, including the international exchange of nuclear material and equipment for the processing, use or production of nuclear material for peaceful purposes in accordance with the provisions of this Article and the principle of safeguarding set forth in the Preamble of the Treaty.


4. Non-nuclear-weapon States Party to the Treaty shall conclude agreements with the International Atomic Energy Agency to meet the requirements of this Article either individually or together with other States in accordance with the Statute of the International Atomic Energy Agency. Negotiation of such agreements shall commence within 180 days from the original entry into force of this Treaty. For States depositing their instruments of ratification or accession after the 180-day period, negotiation of such agreements shall commence not later than the date of such deposit. Such agreements shall enter into force not later than eighteen months after the date of initiation of negotiations.


Article IV


1. Nothing in this Treaty shall be interpreted as affecting the inalienable right of all the Parties to the Treaty to develop research, production and use of nuclear energy for peaceful purposes without discrimination and in conformity with Articles I and II of this Treaty.


2. All the Parties to the Treaty undertake to facilitate, and have the right to participate in, the fullest possible exchange of equipment, materials and scientific and technological information for the peaceful uses of nuclear energy. Parties to the Treaty in a position to do so shall also co-operate in contributing alone or together with other States or international organizations to the further development of the applications of nuclear energy for peaceful purposes, especially in the territories of non-nuclear-weapon States Party to the Treaty, with due consideration for the needs of the developing areas of the world.
Article V


Each Party to the Treaty undertakes to take appropriate measures to ensure that, in accordance with this Treaty, under appropriate international observation and through appropriate international procedures, potential benefits from any peaceful applications of nuclear explosions will be made available to non-nuclear-weapon States Party to the Treaty on a non-discriminatory basis and that the charge to such Parties for the explosive devices used will be as low as possible and exclude any charge for research and development. Non-nuclear-weapon States Party to the Treaty shall be able to obtain such benefits, pursuant to a special international agreement or agreements, through an appropriate international body with adequate representation of non-nuclear-weapon States. Negotiations on this subject shall commence as soon as possible after the Treaty enters into force. Non-nuclear-weapon States Party to the Treaty so desiring may also obtain such benefits pursuant to bilateral agreements.


Article VI


Each of the Parties to the Treaty undertakes to pursue negotiations in good faith on effective measures relating to cessation of the nuclear arms race at an early date and to nuclear disarmament, and on a treaty on general and complete disarmament under strict and effective international control.


Article VII


Nothing in this Treaty affects the right of any group of States to conclude regional treaties in order to assure the total absence of nuclear weapons in their respective territories.


Article VIII


1. Any Party to the Treaty may propose amendments to this Treaty. The text of any proposed amendment shall be submitted to the Depositary Governments which shall circulate it to all Parties to the Treaty. Thereupon, if requested to do so by one-third or more of the Parties to the Treaty, the Depositary Governments shall convene a conference, to which they shall invite all the Parties to the Treaty, to consider such an amendment.


2. Any amendment to this Treaty must be approved by a majority of the votes of all the Parties to the Treaty, including the votes of all nuclear-weapon States Party to the Treaty and all other Parties which, on the date the amendment is circulated, are members of the Board of Governors of the International Atomic Energy Agency. The amendment shall enter into force for each Party that deposits its instrument of ratification of the amendment upon the deposit of such instruments of ratification by a majority of all the Parties, including the instruments of ratification of all nuclear-weapon States Party to the Treaty and all other Parties which, on the date the amendment is circulated, are members of the Board of Governors of the International Atomic Energy Agency. Thereafter, it shall enter into force for any other Party upon the deposit of its instrument of ratification of the amendment.


3. Five years after the entry into force of this Treaty, a conference of Parties to the Treaty shall be held in Geneva, Switzerland, in order to review the operation of this Treaty with a view to assuring that the purposes of the Preamble and the provisions of the Treaty are being realized. At intervals of five years thereafter, a majority of the Parties to the Treaty may obtain, by submitting a proposal to this effect to the Depositary Governments, the convening of further conferences with the same objective of reviewing the operation of the Treaty.


Article IX


1. This Treaty shall be open to all States for signature. Any State which does not sign the Treaty before its entry into force in accordance with paragraph 3 of this Article may accede to it at any time.


2. This Treaty shall be subject to ratification by signatory States. Instruments of ratification and instruments of accession shall be deposited with the Governments of the United
Kingdom of Great Britain and Northern Ireland, the Union of Soviet Socialist Republics and the United States of America, which are hereby designated the Depositary Governments.


3. This Treaty shall enter into force after its ratification by the States, the Governments of which are designated Depositaries of the Treaty, and forty other States signatory to this Treaty and the deposit of their instruments of ratification. For the purposes of this Treaty, a nuclear-weapon State is one which has manufactured and exploded a nuclear weapon or other nuclear explosive device prior to 1 January, 1967.


4. For States whose instruments of ratification or accession are deposited subsequent to the entry into force of this Treaty, it shall enter into force on the date of the deposit of their instruments of ratification or accession.


5. The Depositary Governments shall promptly inform all signatory and acceding States of the date of each signature, the date of deposit of each instrument of ratification or of accession, the date of the entry into force of this Treaty, and the date of receipt of any requests for convening a conference or other notices.


6. This Treaty shall be registered by the Depositary Governments pursuant to Article 102 of the Charter of the United Nations.


Article X


1. Each Party shall in exercising its national sovereignty have the right to withdraw from the Treaty if it decides that extraordinary events, related to the subject matter of this Treaty, have jeopardized the supreme interests of its country. It shall give notice of such withdrawal to all other Parties to the Treaty and to the United Nations Security Council three months in advance. Such notice shall include a statement of the extraordinary events it regards as having jeopardized its supreme interests.


2. Twenty-five years after the entry into force of the Treaty, a conference shall be convened to decide whether the Treaty shall continue in force indefinitely, or shall be extended for an additional fixed period or periods. This decision shall be taken by a majority of the Parties to the Treaty.


Article XI


This Treaty, the English, Russian, French, Spanish and Chinese texts of which are equally authentic, shall be deposited in the archives of the Depositary Governments. Duly certified copies of this Treaty shall be transmitted by the Depositary Governments to the Governments of the signatory and acceding States.


IN WITNESS WHEREOF the undersigned, duly authorized, have signed this Treaty.


DONE in triplicate, at the cities of London, Moscow and Washington, the first day of July, one thousand nine hundred and sixty-eight.
