제60차 유엔 총회 북한 인권 결의안
유엔총회는,
모든 유엔 회원국들이 인권과 기본적 자유를 보호하고 증진하며, 이 분야의 다양한 국제협약에 따라 부여된 의무를 이행할 책무가 있다는 점을 재확인하고,
북한은 「시민적·정치적 권리에 관한 국제규약」, 「경제적·사회적·문화적 권리에 관한 국제규약」, 「아동권리협약」, 「여성차별철폐협약」의 회원국이라는 점에 유의하며,
유엔 인권위원회가 지난 2003년 4월 16일(2003년 10호), 2004년 4월 15일(2004년 13호), 2005년 4월 14일(2005년 11호)에 북한인권결의안을 통과시켰으며, 특히 2005년도 결의안은 북한이 유엔의 북한인권 특별보고관에게 협력하지 않고 북한 인권상황의 개선이 준수되지 않으면 유엔총회가 북한인권 문제를 다룰 것을 촉구했었다는 점을 상기하고,
유엔 북한인권 특별보고관의 2005년 8월 29일자 보고서(A/60/306)를 주목하면서,
1. 다음의 사항에 심각한 우려를 표시한다.
(a) 북한이 유엔 특별보고관의 임무를 인정하지 않고 특별보고관에게 협력도 하지 않는 점.
(b) 북한에서 다음의 사항을 포함한 조직적이고 광범위하며 심각한 인권침해가 행해지고 있다는 보고서가 잇따르고 있는 점.
1) 고문과 여타의 잔인하고 비인간적 혹은 굴욕적인 대우 또는 처벌, 공개처형, 초법적·자의적 구금, 적법한 절차와 법치의 부재, 정치적 이유로 인한 사형, 다수의 정치범 수용소와 광범위한 강제노역의 존재,
2) 북한 이탈을 반역행위로 간주하여 외국에서 송환되어 온 북한 주민들에 대해 행해지는 구금, 고문, 비인간적 또는 굴욕적인 대우, 사형 등의 처벌,
3) 사상, 양심, 종교, 의견 및 표현, 평화적 집회와 결사, 평등한 정보접근과 관련된 자유와 권리의 광범위하고 심각한 제한. 국내 이주자와 해외여행자의 자유이동의 제한,
4) 여성의 인권 및 기본적 자유의 지속적인 침해. 특히 매춘 또는 강제결혼을 목적으로 하는 여성의 인신매매, 강제유산, 경찰 유치소와 노동 교화소 등에서 자행되는 송환된 임산부의 아이에 대한 영아살해,
5) 강제적 실종 형태의 미해결된 외국인 납치 문제.
2. 유엔 인권고등판무관의 북한 당국과의 대화 노력에도 불구하고 북한은 고등판무관 및 판무관실과 기술적인 협력활동을 하지 않고 있다는 점에 또한 우려를 표시한다.
3. 아직도 상당 비율의 아동들의 육체적 정신적 발달에 영향을 끼치는 유아 영양실조의 보편화를 비롯한 북한 내 불안정한 인도주의적 상황에 대한 깊은 우려를 표시한다.
4. 세계식량계획(WFP) 같은 유엔 산하 기관과 비정부단체 등 인권기구들이 북한 내 인도주의 지원이 인도주의 원칙에 따라 필요에 근거하여 공평하게 전달되고 있는지 확인할 수 있도록 이들 인권기구가 북한의 모든 부문에 완전하고 자유롭고 안전하게 그리고 방해 없이 접근할 수 있도록 북한 당국이 보장할 것을 촉구한다. 이 문제에 대한 우려는 북한이 2006년 1월부터 인도적 지원을 받아들이지 않겠다고 선언하면서 더욱 가중되었다.
5. 북한이 모든 인권과 기본적 자유를 철저히 존중할 것과, 이와 관련하여 특히 유엔 특별보고관에 대한 완전한 협력을 비롯한 상기된 유엔 인권위의 결의안 내용의 완전한 이행을 촉구한다.

Human rights questions: human rights situations and reports of special rapporteurs and representatives
Situation of human rights in the Democratic People’s Republic of Korea
The General Assembly,
Reaffirming that States Members of the United Nations have an obligation to promote and protect human rights and fundamental freedoms and to fulfil the obligations that they have undertaken under the various international instruments,
Mindful that the Democratic People’s Republic of Korea is a party to the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention on the Rights of the Child and the Convention on the Elimination of All Forms of Discrimination against Women,
Recalling Commission on Human Rights resolutions 2003/10 of 16 April 2003, 2004/13 of 15 April 2004, and 2005/11 of 14 April 2005,
Recalling in particular that in its resolution 2005/11, the Commission on Human Rights urged the General Assembly to take up the question of the situation of human rights in the Democratic People’s Republic of Korea if the Government did not extend cooperation to the Special Rapporteur of the Commission on the situation of human rights in the Democratic People’s Republic of Korea and if improvement of the situation of human rights in the country was not observed,
Taking note of the report of the Special Rapporteur,
1. Expresses its serious concern at:
(a) The refusal of the Government of the Democratic People’s Republic of Korea to recognize the mandate of the Special Rapporteur of the Commission on Human Rights on the situation of human rights in the Democratic People’s Republic of Korea or to extend cooperation to him;
(b) Continuing reports of systemic, widespread and grave violations of human rights in the Democratic People’s Republic of Korea, including:
(i) Torture and other cruel, inhuman or degrading treatment or punishment, public executions, extrajudicial and arbitrary detention, the absence of due process and the rule of law, the imposition of the death penalty for political reasons, the existence of a large number of prison camps and the extensive use of forced labour;
(ii) Sanctions imposed on citizens of the Democratic People’s Republic of Korea who have been repatriated from abroad, such as treating their departure as treason, leading to punishments of internment, torture, cruel, inhuman or degrading treatment or the death penalty;
(iii) All-pervasive and severe restrictions on the freedoms of thought, conscience, religion, opinion and expression, peaceful assembly and association, and on equal access to information and limitations imposed on every person who wishes to move freely within the country and travel abroad;
(iv) Continued violation of the human rights and fundamental freedoms of women, in particular the trafficking of women for the purpose of prostitution or forced marriage, forced abortions, and infanticide of children of repatriated mothers, including in police detention centres and camps;
(v) Unresolved questions relating to the abduction of foreigners in the form of an enforced disappearance;
2. Expresses its concern that the Government of the Democratic People’s Republic of Korea has not engaged in technical cooperation activities with the United Nations High Commissioner for Human Rights and her Office, despite efforts by the High Commissioner to engage in a dialogue with the authorities of the Democratic People’s Republic of Korea in this regard;
3. Expresses its deep concern at the precarious humanitarian situation in the country, in particular the prevalence of infant malnutrition, which still affects the physical and mental development of a significant proportion of children;
4. Urges the Government of the Democratic People’s Republic of Korea, in this regard, to ensure that humanitarian organizations, including non-governmental organizations and United Nations organizations, in particular the World Food Programme, have full, free, safe and unimpeded access to all parts of the Democratic People’s Republic of korea in order that they may ensure that humanitarian assistance is delivered impartially on the basis of need in accordance with humanitarian principles, this concern having been aggravated by the announcement by the authorities of the Democratic People’s Republic of Korea of their intention not to accept humanitarian assistance from January 2006;
5. Also urges the Government of the Democratic People’s Republic of Korea to fully respect all human rights and fundamental freedoms and, in this regard, to implement fully the measures set out in the above-mentioned resolutions of the Commission on Human Rights, in particular full cooperation with the Special Rapporteur.
